1. Legal Notice Scope

This Legal Notice establishes the General Conditions that regulate both access and navigation, as well as the use of the contents of the websites owned by TWZ.

In addition to the General Conditions regulated in this legal notice, specific conditions may be established to regulate the use of other services offered by TWZ.

In the event of a discrepancy between what is established in these General Conditions and the specific conditions that regulate a specific service, the specific conditions shall prevail.

2. Terms of Use

By simply accessing, browsing, or using or participating in the services and activities, whether free or paid, developed on the websites, you are considered a user. The user fully accepts without any reservation the general conditions outlined in this legal notice, as well as the specific conditions that, if applicable, are established for certain services.

User obligations include:

• Always make lawful use of the services offered, in accordance with current legislation and with the property rights of TWZ and third parties, and not to take any action (including introducing or disseminating “computer viruses”) through our services that may cause damage or alterations to the contents. Also, refrain from interfering with or altering the email of other users.
• Not include on the websites, content that indicates or promotes sexual, racial, religious discrimination, or any other violation of fundamental rights and freedoms recognized by the Spanish Constitution, that induce or incite illegal actions or lead to erroneous conclusions due to inaccuracy, omission, or similar reasons, that contain false or outdated information, that infringe legal or regulatory standards regarding communication secrecy, intellectual property, the right to honor and personal privacy, or that incorporate violent or degrading content, messages, or products.
• For access to certain services, the user must register. The user agrees to provide truthful and lawful information when registering. Users are responsible for the confidentiality of their passwords and agree not to share them or allow their use by third parties.

The right of exclusion is expressly established: TWZ reserves the right to deny or withdraw access to the websites and/or services offered without prior notice, at its own initiative or at the request of third parties, to those users who violate this Legal Notice. Likewise, TWZ will pursue the breach of these conditions as well as any misuse of TWZ websites by exercising all civil and criminal actions available under Spanish and/or Community law.

TWZ may enable third-party entities to advertise or provide their services. In these cases, the group will not be responsible for non-owned websites that may be accessed through links or for any content made available by third parties. Any use of a link or access to a non-owned website will be done at the sole discretion and risk of the user.

Any use of the websites other than that authorized is expressly prohibited.

3. Intellectual Property

All rights to the contents of this website belong to TWZ, except those belonging to its clients or content providers expressly authorized.

For illustrative purposes only, the design, images, maps, graphics, frames, banners, software and its various codes, source and object, and other elements integrated into the website are owned by TWZ, which legitimately owns the exploitation rights over them exclusively. Consequently, users accessing the website cannot under any circumstances copy, modify, distribute, transmit, reproduce, publish, license, assign, sell, or transmit them in any way, or create new products or services derived from the information and elements contained herein. Only the mere visualization and loading for the personal and non-commercial use of the user is authorized, without being able to extend it to third parties or entities.

In the case of designs or graphics appearing on this website that are owned by companies or entities collaborating with TWZ, the present conditions and protection will also apply, except for the express and written consent of said companies or entities.

Any technological or technical resources by which a third party or users may benefit, with or without profit, from the contents, forms, indices, and other formal expressions that are part of the website are prohibited. • The link will be directed to the main page or any of its sections. The link must be absolute and complete, leading the user with a single click to the URL of the home page or to the URL of any of the sections of the website. The link must cover the entire screen extension of the website.
• Under no circumstances, unless expressly authorized in writing by TWZ, may the website establishing the link reproduce the website in any way, including it as an integral part of its website, using frames, redirects, or any other measure that hides the origin of the information.

5. Disclaimer

TWZ assumes no responsibility whatsoever for the lack of truthfulness, completeness, updating, and accuracy of data or information of any kind relating to products or services offered by third parties through the website, nor for the information contained on third-party websites accessible through hypertext links from IDS websites.

In particular, TWZ assumes no responsibility for the accuracy of the information directly originated by its clients and users, whether they are offers and demands, informative reviews of products or services, corporate information of companies, or any other content derived from documentation owned by clients and users.

In no case shall TWZ, its branches and/or workplaces, its directors and/or representatives, employees, and, in general, authorized personnel be liable for any kind of damage, losses, claims, or expenses of any kind, whether direct or indirect, arising from the use and/or dissemination of the website or information, operational failures or interruptions in service or transmission, or failures in line use of the website, both by direct connection and by link or any other means, constituting for all legal purposes a notice to any user that these possibilities and events may occur.

TWZ reserves the right to modify, suspend, cancel, or restrict the content of the website, links, or the information obtained through it, without prior notice and without generating any type of compensation. In no case shall IDS assume any responsibility as a result of the incorrect use of the website that the user may carry out, both of the information and the services contained therein.

6. Rules for Posting Comments and News/Press Releases

The user may occasionally submit news or press releases to be published on the various websites. Spaces may also be occasionally enabled for users to comment on published news.

The use of this service is subject to the following clauses:

• The publication of the news, press release, or comment is entirely discretionary at the exclusive discretion of TWZ. The user accepts the possibility that when submitting the news, press release, or comment, it may not be published. The non-publication of the submitted material will not result in any form of compensation.
• User Responsibility: By participating in potentially enabled spaces, the user is solely responsible for the messages they disseminate through them, guaranteeing IDS complete indemnity against any claims that may arise from such messages.
• In the event that messages contain material protected by intellectual or industrial property rights, the user guarantees that they are the owner or have the owner’s authorization to disseminate it. Exempting TWZ from any third-party claims that may arise from such material.
• Contents: Before posting a message, the user must choose the appropriate space. Messages that do not comply with the thematic content of the website may be deleted. In the publication of comments, advertisements, email chains, or any other content that is not related to expressing opinions or debating articles or news are not accepted. By using the Services, the User expresses their agreement with these General Conditions, committing not to use them to send messages that defame or insult, or contain false information, are inappropriate, abusive, harmful, pornographic, threatening, damaging the public image and/or the private life of third parties or that, for any reason, infringe any law.
• Mutual Respect: The user must respect other users. The user must be tolerant and respectful of the messages and opinions of others.
• TWZ may limit, to the extent it is aware of it, access to opinion, information, comment, image websites, and, in general, any material that violates the above. Accordingly, TWZ will be empowered to immediately suspend the provision of the service and, where appropriate, to remove content that is alleged or clearly illegal, whether done at its sole discretion or at the request of the affected third party or competent authority.
• Assignment of Content: TWZ reserves the right to reproduce, modify, or disseminate messages published on the website’s blogs in accordance with appropriate terms and means without entitling the user to any compensation.
• Disclaimer: TWZ is not responsible for the content published in the website’s comments and news nor does it guarantee the truthfulness or accuracy of any information published therein. The responsibility for the content lies with the user sending the messages or information.
• Service Integrity: TWZ does not guarantee the availability or continuity of the comments and news sections of its websites, and may modify, suspend, or remove it from the website without prior notice at any time.
• Report: If a user may be affected by illegal actions, or detects misuse of these sections of the website by other users, they may notify TWZ via email at twz@thewarzone.blog, indicating in the subject line “user content moderation”, so that we can moderate or remove them.
• Medium Indemnity: The user will indemnify TWZ against any claims that may arise from the messages disseminated by the user in the blogs or from any other conduct linked to or derived from the user’s use of the website’s blogs.

7. Advertising Regulations, Advertisements, and Media Content

Advertisements published in any sections of the websites enabled for this purpose must relate to elements related to them and comply with the specific rules indicated in each case. As a general consideration: the contents of the websites are of a professional nature and intended for industrial companies and the professionals associated with them. Advertisements or information outside the specified sections in the different sections of the website will require prior written authorization from TWZ.

Specifically, advertisements related to commerce or relations between individuals will not be accepted, and no type of advertising or information referring to personal contacts, gambling, smuggling, money solicitation, or any illegal product or activity will be accepted.

TWZ reserves the discretionary right not to publish any information it deems inappropriate for its purpose, as well as to update the contents of the website, delete them, limit them, restrict or prevent access to them, whether temporarily or permanently. If, in the user’s opinion, contrary behaviors to those indicated in this Legal Notice or current regulations occur within the framework of the services offered by the website, it should be notified to ids@idsolutions.biz, who undertakes to do everything possible to eradicate any misuse of the Web.

Intellectual Property of Media

The user declares, under their absolute responsibility, that they have the intellectual property rights, or the permission of the holder thereof, for the photographs, graphics, images, videos, audios, digital documents, and any other type of “media” uploaded or provided through any means for incorporation into TWZ’s websites.

The user thus assures TWZ’s indemnity against third-party claims regarding the copyright of the aforementioned “media.” The user will be directly responsible for any damages and losses that may arise from third-party claims for the infringement of intellectual property rights, exempting TWZ from any type of claim or compensation, without any reservations.

By submitting any type of media, the user accepts that such media may be used by TWZ for publication on the websites, printed publications, videos, or other formats, and eventually, TWZ’s promotional or advertising materials.

8. Purchase of Publications

TWZ offers users and visitors to its websites the option to purchase its printed publications online.

To place an order, the user must complete all the fields in the form, and once the data is submitted, they will receive an email confirming the purchase and notifying them of the total invoice amount.

As established by current legislation, returns of editorial products such as magazines and books are not accepted.

The amounts indicated include the corresponding VAT (21%) for purchases made from Spain.

9. Applicable Legislation and Competent Jurisdiction

This legal notice and the general conditions set forth herein shall be governed by Spanish law.

TWZ and the user expressly waive any other jurisdiction that may correspond to them. They submit to the jurisdiction of the Courts and Tribunals of Madrid for all matters or actions that may arise from the provision of the group’s website services and the interpretation, application, compliance, or non-compliance with the provisions of this legal notice.
